Terms and Conditions, Tia

1. About these terms

These terms form a binding agreement between you and Fig Tree Capital Limited, trading as Tia (“Tia”, “we”, “us”), a company registered in Kenya. By creating an account or using the platform you agree to be bound by them. If you do not agree, please do not use the service.

2. Who can use Tia

You must be at least 18 years old and legally able to enter into a contract. Venues must be lawfully registered businesses in their country of operation.

3. Accounts

You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity on your account. Tell us promptly if you suspect unauthorised use.

4. Training and credentials

Certificates are issued when you complete the required modules and pass the associated assessments. Credentials remain the property of Tia and may be revoked where issued in error or obtained by fraud.

5. Job listings and hiring

Venues are responsible for the accuracy of their listings, for compliance with applicable employment law, and for the terms they offer to candidates. Tia is not the employer and is not a party to any employment contract entered into through the platform.

6. Verification

We may request business licences, identification and other records to verify the accounts of venues and workers. We may suspend or remove accounts where verification fails or where information appears fraudulent.

7. Acceptable use

You agree not to:

Provide false or misleading information.
Post content that is unlawful, discriminatory, harassing or infringes another person’s rights.
Attempt to access the platform in ways that are not authorised, or interfere with its operation.
Use the platform to solicit payments or personal information outside of the intended flows.

8. Fees

Pricing for training and for employer subscriptions is set out on the platform and may be updated from time to time. Fees already paid are non-refundable except where required by law.

9. Intellectual property

The platform, its training content and its branding are owned by Tia or its licensors. You are granted a limited, personal, non-transferable licence to use the service for its intended purpose. You retain ownership of the content you upload, and grant Tia a licence to host and display it as needed to run the service.

10. Suspension and termination

We may suspend or close an account that breaches these terms, that appears to be fraudulent, or where required by law. You may close your account at any time from your settings.

11. Disclaimers

The platform is provided on an “as is” basis. We do not guarantee that a candidate will be hired or that a role will be filled. To the extent permitted by law, we exclude all implied warranties.

12. Liability

To the extent permitted by law, Tia’s total liability to you in connection with the platform is limited to the fees you have paid to us in the twelve months before the event giving rise to the claim.

13. Governing law

These terms are governed by the laws of Kenya. The courts of Kenya have exclusive jurisdiction over any dispute arising from them, without prejudice to any mandatory consumer rights you may have.

14. Changes

We may update these terms from time to time. Material changes will be notified through the platform or by email before they take effect. Continued use of the service after the effective date constitutes acceptance.
